General Conditions of Rutten Watches located in Arnhem
1. General
1.1 These general conditions apply to all offers of Rutten Watches. The conditions are accessible to all and can be found on the website of Rutten Watches. We can send a paper copy by request.
1.2 By placing an order you agree with the delivery and payment conditions. Rutten Watches can change the delivery or payment conditions.
1.3 Unless agreed differently in writing Rutten Watches does not acknowledge specific conditions of third parties.
1.4 Rutten Watches guarantees that the products are true to their description and meet the listed specifications.
2. Delivery
2.1 We deliver products as long as they are on hand.
2.2 In line with the rules in regard to “buying from distance”, Rutten Watches will execute all orders within 30 days of placement. If this is not possible because the article is not in stock, or delayed for another reason, or an order can not be executed or only partly, the client will be informed within 1 month of order placement. From that moment the client has the right to cancel the order without any additional costs.
2.3 Rutten Watches has fulfilled its delivery duty after the item has been offered to the customer once. A report from the postal worker about refusal of acceptance is a complete piece of evidence (of offering the item to the client).
2.4 The periods of time mentioned on our website are just an indication. No rights can be derived from these indications.
3. Prices
3.1Prices will not be raised during the running time of an offer, unless legal measures force us to do this or if the manufacturer has a price change.
3.2 All prices on this website need some qualification. There might be print or other mistakes. We cannot be held accountable for these mistakes.
3.3 All prices on this website are in EURO’s and a VAT of 19% has been included.
4. Grace period / right to withdrawal
4.1 In case of a purchase by a consumer that follows the law for distance buys (article 7:5 BW), the client has the right to return (part of) the order within a period of 7 business days without stating a reason. This period starts on the date of delivery. If the client has not shipped the items back to Rutten Watches within this period, the client has officially purchased the item(s).
Besides shipping the item(s) back, the client has to also notify Rutten Watches of this fact in writing. The client must be able to prove that the package has been shipped in time, for example with a bill from the post office.
The items must be shipped back in their original package (including accessories and documentation) and must be unused and undamaged. If the items have been used, damaged or anything else is found wrong with them the client can no longer return the item and receive his money back. If these rules are followed, Rutten Watches will return the money within 30 days of receiving the package. The full amount including shipping costs will be returned. The client will have the pay the postage for shipping the items back to us.
4.2 The rules above only apply to items that have been delivered to the client and ordered by the client.
4.3 The right of withdrawal does not apply in the following cases:
-
services that have been set in motion, in agreement with the client, before the period of 7 business days;
-
services of products of which the price is subject to changes in the financial market, on which the supplier has no influence;
-
products that have been created according to specifications from the client, for example goods that are made to measure or have a clear personal character;
-
products or services that cannot be shipped back because of their nature, for example for hygiene or expiration reasons;
-
audio- and video-recordings and computer programs of which the client has broken the seal;
-
delivery of newspapers and magazines;
-
The services of lotteries and bets;
5. Data management
5.1 When you place an order with Rutten Watches, your information will we added in our customer archive. Rutten Watches will not give your information to third parties. See our Privacy Policy.
5.2 Rutten Watches respects the privacy of the users of the website and therefore cares for a secure handling of personal information.
5.3 Rutten Watches uses a mailing list in some cases. Each mailing will give instructions on how to remove oneself from the list.
6. Guarantee
6.1 Rutten Watches guarantees that the products sold by her meet the requirements of usefulness, safety and lifespan as intended in the purchase-agreement. Every product comes with a guarantee.
6.2 The guarantee term of Rutten watches is the same as the factory guarantee term. Rutten watches is never responsible for the suitableness of a product for an individual customer, nor for possible advises about how to use items.
6.3 The client must check the items upon delivery. If there is something wrong with the received items, the client must notify Rutten Watches of this, in writing (before sending the item back). This must be done within two weeks. Packages must be returned in their original wrapping (including accessories and documentation) and must be unused. None of these rights apply when the item has been used after the client found something wrong with them or if the item has been resold to someone else.
6.4 When a complain from the customer is found legitimate by Rutten Watches, the item will be replaced without any extra cost or another from of compensation will be agreed on in writing. The amount paid by Rutten Watches can never be higher than the cost of the actual order. The responsibility insurance of Rutten Watches may be a factor in how much money can be paid back to the customer. Rutten Watches cannot be held accountable for any additional damage the client may have encountered.
6.5 Rutten Watches cannot be held accountable for damage caused by intent or similar reckless behavior of non-managerial personnel.
6.6 This guarantee does not apply in these cases: A) as long as the client has not done certain things that he/she had agreed to do; B) the client has attempted to repair/alter the product himself or has had third parties assist in this. C) The items have been exposed to abnormal circumstances or have not been treated in a careful manner. Items must be used in the way that is specified in the manual. D) The fault in the item is (partly) caused by demands set by the government about these items or the quality of the items.
7. Offers
7.1 Offers are without engagement of any kind, unless specified differently.
7.2 When a client accepts an offer, Rutten Watches has the right to change the offer within 3 business days or to change the terms.
7.3 Verbal vows from Rutten Watches do not have any legal power unless they are explicitly put in writing and confirmed by both parties.
7.4 Offers from Rutten Watches do not automatically apply to backorders.
7.5 Rutten Watches cannot be expected to keep to its offer when the client could have been expected to have understood that there was a mistake in (part of) the offer.
7.6 Supplements, changes or further agreements are only active after they are agreed to in writing.
8. Agreement
8.1 An agreement between Rutten Watches and a client is established after an order has been checked for attainability by Rutten Watches.
8.2 Rutten Watches has the right to not accept an order without stating a reason. Rutten watches may also only accept the order under certain conditions for example: the order can only be shipped with cash on delivery or the order must be paid for in advance.
9. Images and specifications
9.1All images (photos, drawings etc.) and all information in regard to weight, measurements, colors, pictures of labels etc. on the website of Rutten Watches are only meant as an indication. They can not be used for withdrawing from the agreement or getting your money back.
10. Circumstances outside one’s control
10.1 Rutten Watches cannot be held accountable, when orders cannot be processed because of circumstances outside one’s control.
10.2 With “circumstance outside one’s control” we mean all strange causes, and all strange circumstances, that should not happen normally and Rutten Watches is not responsible for. Examples: Delays or failures from our suppliers, internet failure, power outage, email errors or changes in technology by third parties, transport problems, strikes, government measures, negligence and delays from suppliers and factories, illness of personnel.
10.3 Rutten Watches has the right to delay its responsibilities in these cases or to cancel the agreement fully or partly. Rutten watches could also decide to change the agreement so that it is still possible to execute the order. In no case can Rutten watches be expected to pay any kind of fine or compensation.
10.4 When the problems present themselves when Rutten watches has already finished part of an order, they have the right to bill this part of the order separately. The client must pay this bill. This does not apply when part of the order has no independent use without other pieces of the order.
11. Liability
11.1 Rutten Watches cannot be held accountable for use caused to vehicles or other objects because products are used in the wrong way. Read the manual or our website before using a product.
12. Ownership reservations
12.1 Ownership of products sold and delivered to clients remains with Rutten watches as long as the client has outstanding debt from earlier or later similar orders. As long as the client has not provided the services from this agreement or an earlier one. And when the client has bills unpaid to Rutten watches. Article 3:92 BW applies.
12.2 The items delivered by Rutten Watches that fall under the ownership reservations can only be sold in a regular company practice and can never be use as a method of payment.
12.3 The client is not allowed to pawn the items that fall under the ownership reservations in any way.
12.4 The client gives unconditional and unchangeable permission that Rutten Watches or a third party appointed by Rutten Watches can enter the property where its items are and take these.
12.5 When third parties claim the items that fall under the ownership reservations, the clients must inform Rutten watches about this as soon as is reasonably possible.
12.6 The client must insure the items that fall under the ownership reservations for fire, explosion and water damage and also for theft. The client must be able to show the insurance policy to Rutten Watches at the first request.
13. Applicable law/authorized judge
13.1 The Dutch law applies to all agreements.
13.2 All disputes, resulting from an agreement between Rutten Watches and the client, which cannot be solved by the two parties, will be handled by the judge of the jurisdiction of Arnhem. Unless Rutten Watches decided to use a judge from the jurisdiction in which the client is located. The canton judge is an exeption from this.
14. Applicable law
The Dutch law applies to the general conditions and this website.
